Foreign Trade Legislation

Foreign Trade Legislation Is Based On Three Basic Legs. Customs Legislation – Regulates and manages the Movement of Goods. Regimes – Includes regulations regarding the import and exportability of goods. Foreign Exchange Legislation – Makes the regulations related to the Money Movement.

The legislation, which constitutes the three basic pillars of foreign trade transactions, is managed and directed by three institutions. These institutions are the General Directorate of Imports and the General Directorate of Exports, which still serve under the Ministry of Commerce. These two General Directorates; It regulates foreign trade procedures. Import Regime, Export Regime and a series of practices and regulations regarding import and export transactions are carried out under the coordination of these two general directorates.

The second institution is the General Directorate of Customs, which also serves under the Ministry of Commerce. This institution also manages and directs the goods movements, the regulations regarding the implementation and follow-up of Customs duties and Trade Policy measures, and the customs rules to be applied to the goods and vehicles entering and leaving the Customs Territory of the Republic of Turkey.

The Customs Law No. 4458, Customs Regulation, Smuggling Law No. 5607 and the regulations in which the procedures and principles regarding the implementation of the legislation are determined are coordinated by the General Directorate of Customs, Risk Management, Liquidation and Revolving Funds, and the General Directorate of Customs Enforcement.

The third institution directs the payments related to foreign trade transactions, in other words the movement of money, within the body of the Ministry of Treasury and Finance. This legislation is called Foreign Exchange legislation.

What is the Export Regime and actual exports?

The export regime is the regime in which the provisions regarding the exit of the goods in free circulation out of the Customs Territory of Turkey for export purposes are applied. On the other hand, the actual export is the fact that the goods to be exported keep the same condition and quality at the time of the registration of the relevant export declaration, even when it leaves the customs inspection, and leave the Turkish Customs Territory in this state.

Are all kinds of goods allowed to be exported?

Goods whose export is prohibited and subject to permission are listed in the Communiqué on Export: 96/31 published by the Undersecretariat of Foreign Trade, and goods whose export is subject to registration are listed in the Export Regulation.

What is the Outward Processing Regime? What are the facilities provided within the framework of this Regime?

In Article 135 of the Customs Law, the Outward Processing Regime is defined as the regime in which the provisions regarding the temporary export of the goods in free circulation from the Customs Territory of Turkey to be subjected to outward processing activities and the re-entry into free circulation of the products obtained as a result of these activities with full or partial exemption from import duties are defined. .

Based on the aforementioned definition, it is also possible to define the Outward Processing Regime as the processing activities carried out outside the Customs Territory of Turkey by manufacturers who want to increase their competitiveness by reducing their production costs.
